Conservation Commission
Meeting   
May 6, 2010


Peg Arguimbau Chairman, Keevin Geller, Elizabeth McGrath, Hank Langstroth, and Stephen Cremer were the members present.

7:45 p.m., N. O. I. Hearing continuance - 1245 Providence Highway Realty Trust for the proposed pavement of an existing gravel parking area and drainage improvements within the 100’ Buffer Zone at 1245 Providence Highway, DEP FILE #SE-280-0513:

The Applicant was absent from the meeting.
The Commission reviewed the additional submitted information that was requested from the Applicant for the proposed restoration work within the existing drainage swale on the proposed project site.
The Conservation Administrator explained to the Commission that the Zoning Board of Appeals has issued the variances requested by the Applicant concerning the proposed project.
The Commission agreed that the Applicant has addressed all of the concerns of the Commission regarding the proposed project and determined to close the hearing.
Peg called for a motion to close the hearing due to the Applicant’s compliance with the Commission and approval from the Zoning Board of Appeals.
Keevin Geller moved. Hank Langstroth seconded. Voted. Unanimous. 5-0-0.

8:00 p.m., RDA Public Hearing filed by Mass. Highway District 5, for the proposed work on Routes 1, I-95, and S. Main Street. The proposed project includes the trimming or removal of all dead, dying, or unsafe trees within the State Highway Layout:

The Applicant requested that the Commission continue the hearing as he was unable to attend the hearing at this time.
Peg called for a motion to continue the Request for Determination Hearing until further notified by the Applicant.
Elizabeth McGrath moved. Hank Langstroth seconded. Voted. Unanimous. 5-0-0.  

8:10 p.m., RDA Public Hearing filed by the Massachusetts Department of Transportation, Highway Division, District 5, for the proposed work on Route I-95 in Sharon concerning the application of herbicides at spot locations under an approved Vegetation Management Plan:

The Applicant requested that the Commission continue the hearing as he was unable to attend the meeting at this time.
Peg called for a motion to continue the Request for Determination Hearing until further notified by the Applicant.
Hank Langstroth moved. Elizabeth McGrath seconded. Voted. Unanimous. 5-0-0.

8:20 p.m., RDA Public Hearing filed by the Massachusetts Department of Transportation, Highway    Division, District 5, for the proposed work on Route 1 in Sharon, concerning the application of herbicides at spot locations under an approved Vegetation Management Plan:

8:30 p.m., Discussion concerning the Bella Estates Enforcement Order:

Attorney Shelmerdine appeared before the Commission and presented a list of the proposed and completed work thus far in conjunction with the Enforcement Order issued by the Commission on
April 1, 2010. As a result of his recent site visit with the Conservation Administrator, it was agreed that the erosion gullies on the north side of the roadway be filled in with ¾” stone to prevent further erosion.
Attorney Shelmerdine reviewed the proposed work as stated on the list submitted to the Commission:
  • Item # 9 - Catch Basin Cleaning: To commence early next week with a completion date by May 14, 2010.
  • Item # 10 - Rain Gullies: The installation of  ¾” stone to fill in the erosion gullies on the north side of the roadway is expected to be completed by May 21, 2010.
  • Item # 11 – To replenish the hydro-seed to stabilize the vacant lots on the north side of the
roadway by May 21, 2010.
  • Item # 12 - The removal of the silt from the lower basin and restore the bottom of the basin as soon as the basin is dry.
  • Item #13 - To hydro-seed the sides of the lower basin when the basin is dry.
  • Item #14 - To replenish the hydro-seed by May 21, 2010, on the high slopes along the emergency roadway.
  • Item #15 - To clean the lower basin to its original depth as soon as the basin is dry.
  • Item #16 - To install a level spreader at the bottom culvert or consider an alternative outlet.
  • Item #17 – Slope review: The Planning Board has requested that Tom Houston review the
erosion control problems on the south side of the roadway.   
The Commission expressed the following concerns:
  • For the Applicant to report back to the Commission as to whether a level spreader would be installed at the bottom culvert as opposed to a new culvert with a level spreader being installed in a different location on the site.
  • For the Applicant to notify the Commission upon the completion of hydro-seeding and basin cleaning on the north side of the roadway.
The Conservation Administrator suggested that the Applicant plant a blanket of native seed mix to reinforce the slope area between the lower basin and the wetland areas of the site.
The Conservation Administrator agreed to meet with Attorney Shelmerdine, Tom Houston, Peter O’Cain, and Joe Kent, for a site inspection on May 10, 2010.
Attorney Shelmerdine agreed to report back to the Commission on June 3, 2010 at 8:00 p.m.  
Update – Cranberry Bog Area:
Attorney Shelmerdine informed the Commission that Fred Bottomley has been actively working on the Cranberry Bogs adjacent to Old Post Road. The ten-year lease agreement is in consideration of the harvesting of the Cranberry Bogs. Attorney Shelmerdine indicated that the conveyance of the current lease agreement to the Town, or its Conservation Commission, might occur upon the issuance of the first Building Permit or the first Certificate of Occupancy.

9:00 p.m., Old/New Business:

-140 Maskwonicut Street:

The Conservation Administrator explained to the Commission that Mr. Dangelo has sold his property at 140 Maskwonicut Street and hopes to complete the restoration work and process the Conservation Restriction as previously discussed with the Commission. The court date concerning the pending violation is scheduled for May 24, 2010. The Conservation Administrator met with the new owners of the property and learned that they were not fully informed about the situation.

- Brochures Commemorating the Commission’s 50th Anniversary:

Peg called for a motion that the balance of the printing charge be expended from the Commission’s Donation Account for the informational brochures presented by the Friends of Conservation.
Stephen Cremer moved. Hank Langstroth seconded. Voted. Unanimous. 5-0-0.

-Massapoag Sportsmen’s Club Special Act Petition Legislation:

Peg informed the members of the Commission that Governor Patrick has approved the legislation for the conveyance of land approved by the Town under Article 12 of the November 9, 2009 Special Town Meeting.

9:10 p.m., Signatures:
